Welcome to MyWalkup. These Terms and Conditions (“Terms”) govern your access to and use of the MyWalkup mobile application, website, products, services, features, content, and related offerings collectively referred to as the “Service.”
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
MyWalkup is a sports and team management application that helps users create, manage, and personalize in-game player announcements, including team rosters, player profiles, song preferences, audio settings, voice preferences, invitations, and related features.
The Service is intended for use by parents, guardians, coaches, team administrators, players age 13 or older, and other authorized users.
You must be at least 13 years old to use the Service.
The Service is not directed to children under 13, and MyWalkup does not knowingly allow children under 13 to create accounts or use the Service.
If you are under the age of majority in your state, province, or country, you may use the Service only with permission from a parent or legal guardian.
If you use the Service on behalf of a team, organization, player, or other person, you represent that you have the authority and permission to do so.
Certain features of the Service may require an account.
You agree to provide accurate, current, and complete information when creating or using an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify MyWalkup promptly if you believe your account has been accessed without authorization.
The Service may allow users to create or manage team names, player names, jersey numbers, song preferences, audio settings, voice preferences, team invitations, and related information.
You are responsible for ensuring that you have the right and permission to submit, manage, or share any team, player, or organization information through the Service.
If you submit information about another person, including a player, you represent that you have the necessary permission to do so.
You agree not to submit information about a child under 13.
“User Content” means any information, names, team data, player data, photos, avatars, preferences, audio settings, messages, prompts, feedback, or other materials that you submit, upload, create, or share through the Service.
You retain ownership of your User Content.
By submitting User Content to the Service, you grant MyWalkup a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, process, display, and transmit your User Content as needed to operate, provide, improve, maintain, secure, and support the Service.
You represent and warrant that:
The Service may include artificial intelligence, automated tools, or other technologies that help generate, customize, suggest, or process announcment content, player introductions, audio settings, voice preferences, or related materials.
AI-generated or automated content may be inaccurate, incomplete, inappropriate, or unsuitable for your intended use. You are responsible for reviewing, editing, approving, and determining whether any generated content is appropriate before using, publishing, sharing, or playing it publicly.
MyWalkup does not guarantee that generated content will be unique, error-free, suitable for public performance, or free from third-party claims.
You agree not to use generated content in a way that is unlawful, defamatory, harassing, discriminatory, misleading, infringing, or harmful.
The Service may allow users to manage song preferences, audio settings, voice preferences, or related content.
MyWalkup does not grant you any rights to copyrighted music, recordings, lyrics, sound effects, or third-party audio content unless expressly stated.
You are solely responsible for ensuring that any music, audio, announcement, or other content used at games, tournaments, schools, public venues, events, livestreams, recordings, or online platforms complies with applicable laws, venue rules, league rules, platform rules, copyright requirements, and public performance licensing obligations.
MyWalkup is not responsible for how you use music, audio, or generated content outside the Service.
You agree not to use the Service to:
We may remove content, restrict access, suspend accounts, or terminate accounts that violate these Terms.
The Service may use SMS messaging for authentication, account access, verification, team invitations, security notifications, and other transactional purposes.
By providing your phone number and opting in to SMS messages, you agree to receive transactional SMS messages from MyWalkup. Message frequency may vary based on your account activity.
Standard message and data rates may apply.
You may opt out of SMS messages by replying STOP to a message or by disabling SMS notifications in your account settings, where available. You may reply HELP for support information.
Carriers are not liable for delayed or undelivered messages.
Your phone number and SMS consent will not be shared with third parties for their own marketing or promotional purposes.

Some features of the Service may require payment or a subscription.
If paid features are offered, pricing, billing terms, renewal terms, cancellation rights, and refund policies will be presented at or before purchase.
If you purchase through the Apple App Store, Google Play, or another third-party platform, your purchase may be subject to that platform’s terms, payment policies, refund rules, and subscription management procedures.
Unless otherwise stated or required by law, fees are non-refundable.
The Service may rely on or integrate with third-party services, including payment processors, app stores, analytics providers, crash reporting tools, subscription management tools, SMS providers, hosting providers, and other technology providers.
Your use of third-party services may be governed by their own terms and privacy policies.
MyWalkup is not responsible for third-party services, content, systems, availability, policies, or practices.

The Service is not directed to children under 13.
MyWalkup does not knowingly collect personal information from children under 13 or knowingly allow children under 13 to use the Service.

The Service, including its software, design, branding, logos, features, systems, workflows, text, graphics, and other materials, is owned by MyWalkup or its licensors and is protected by intellectual property laws.
Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service without written permission from MyWalkup.
The name “MyWalkup,” related logos, product names, slogans, and branding may not be used without permission.
If you provide ideas, suggestions, comments, improvements, or other feedback about the Service, you grant MyWalkup the right to use that feedback without restriction or compensation to you.

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law rules.
Before filing a claim, you agree to first contact us at admin@mywalkup.ai and attempt to resolve the dispute informally.
If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Utah County, Utah, unless otherwise required by law.
You consent to the personal jurisdiction and venue of those courts.
To the fullest extent permitted by law, you and MyWalkup agree that any dispute will be brought only on an individual basis and not as a class action, collective action, consolidated action, private attorney general action, or representative proceeding.
If you download or use the Service through the Apple App Store, Google Play, or another app marketplace, your use may also be subject to that marketplace’s terms, conditions, and policies.
If there is a conflict between these Terms and the applicable app marketplace terms, the app marketplace terms may control only to the extent required by that marketplace.
